TERMS AND CONDITIONS OF ENTRY INTO "Marsh Summer of Cricket experience” Competition
- Information on how to enter and prize details form part of these conditions. Entry into this Promotion is deemed acceptance of these terms and conditions of entry.
- The Promoter is Marsh Pty Ltd (ABN 86 004 651 512 AFS licence number 238 983) of One International Towers, 100 Barangaroo Ave, Sydney NSW 2000, Australia ("Promoter").
- Cricket Australia (ABN 53 006 089 130) of 60 Jolimont Street, Jolimont Victoria 3002 (“Cricket Australia”).
- The “Marsh Summer of Cricket experience” Competition commences at 8:00am AEDT on Sunday 16th October 2022 and ends at 11:59pm AEDT on Monday 14th November 2022 ("Promotion Period").
- Entry is open to Australian residents who are aged 18 years and over, have a valid telephone number and valid email address (“Eligible Entrants”). Where applicable all Eligible Entrants will be required to provide proof of eligibility to redeem their prize.
- Employees (and their immediate family members) of Marsh and agencies associated with this promotion are ineligible. An ‘immediate family member’ includes any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
- An Eligible Entrant must, during the Promotion Period must:
- Submit an online entry at the URL https://gameplan.partnership-hub.com/ultimate-summer-cricket-experience
- by providing your full name, mobile number, email address and accept these Terms and Conditions where required on the Competition Landing Page (Eligible Entry).
- A maximum of six (6) entries to the competition applies subject to the following:
- A limit of one (1) Eligible Entry to the competition per Eligible Entrant applies. The use of any automated entry software of any other mechanical or electronic means that allows an entrant to automatically enter the competition repeatedly is prohibited and will render entries submitted using such means invalid. Any subsequent entry after the first valid entry is received will be deemed invalid.
- A limit of five (5) bonus entries per Eligible Entrant applies upon completing the bonus entries survey.
- The total prize pool value is AUD $2,620.00. There will be one (1) individual prize in total. The prize consists of four (4) reserved tickets to Day 1 of the Vodafone Test Series of your choice (up to AUD $620.00), one (1) AUD $500.00 VISA Gift Card (or similar) for food and beverages, one (1) Money Can’t Buy Experience (AUD $1,000.00), one (1) Signed Bat (AUD $500.00). The prize/s is not transferable, exchangeable or redeemable for cash. A prize must be taken as offered and cannot be varied. The prize does not include any travel related expenses. The prize value is the recommended retail price including GST.
- The Competition prize details are correct at time of publishing these Terms and Conditions.
- The winners will be determined at 9:00am AEDT on Tuesday 15th November 2022. Winners will be determined by way of random selection by the Promoter from the eligible entries. One (1) winner will be chosen by random draw which will take place at Greenroom Digital, 343 Ferrars Street South Melbourne VIC 3205. The Promoter will take all reasonable steps to contact the winners as set out below in clause 14.
- This is a game of chance and skill plays no part in determining the winners.
- The judges' decision (including any decisions as to prize distribution) is final and the Promoter will not enter into correspondence regarding the result.
- The winners will be notified by phone and in writing (email) within 2 days of the draw using the details provided at the time of entry. Should attempts to contact be unsuccessful after one (1) week, an unclaimed prize draw will take place on Monday 22nd November 2022 at the same place and time as the original draw. To claim the prize the winners must respond in writing (email).
- The Promoter and Cricket Australia accepts no responsibility for any entries not received for any reason during the Promotion Period. No responsibility will be taken for lost, late or misdirected entries. The Promoter and Cricket Australia are not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.
- Incomplete, illegible and incorrect entries or entries containing offensive or defamatory comments, or which breach any law or infringe any third-party rights, including intellectual property rights, are not eligible to win.
- If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any individual; or (b) to modify, suspend, terminate or cancel the Promotion, as appropriate.
- Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Investment Commissions Act 2001 (Cth) or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and Cricket Australia (including their respective officers, employees and agents) excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of this promotion.
- Any entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, or who does not properly comply with the entry process, will be ineligible to win.
- The Promoter reserves the right to disqualify entries in the event of non-compliance with these terms and conditions of entry. In the event there is a dispute concerning the conduct of the Promotion, the decision of the Promoter is final and binding on each entrant and no correspondence will be entered into.
- By entering the Competition, all entrants agree that their entry and name may be used by the Promoter for publicity and marketing purposes. Any personal data relating to the winner or any other entrants will be used solely in accordance with current Australian data protection and privacy legislation and the Promoter’s Privacy Policy available at: https://www.marsh.com/au/privacy-policy.html
- If you have selected the option to receive information and offers from Australian Cricket, you understand and agree that Cricket Australia also collects your personal information, including on behalf of State or Territory cricket associations, including the Big Bash League teams (together, "Australian Cricket") to communicate with you, and for any of the purposes set out in Australian Cricket's Privacy Policy (available at www.cricket.com.au/privacy or by emailing [email protected]), and that the personal information you provide will be disclosed to and used by Australian Cricket under the terms of Australian Cricket's Privacy Policy, which contains information about how you may access and seek to correct your personal information or complain about a breach of your privacy, and how Australian Cricket will deal with that complaint. Australian Cricket may disclose your personal information to other parties, including Australian Cricket's third party service providers. From time to time, these third parties may be located (and so your personal information may be disclosed) overseas, including in India, the USA and the UK, and other countries from time to time. Australian Cricket may use and disclose your personal information for direct marketing purposes, unless you opt out (which you can do at any time in accordance with Australian Cricket's Privacy Policy), and for facilitating further offers directly from third parties if you opt in to receive those offers. You can request to access, update or correct any personal information Australian Cricket holds about you by writing to Cricket Australia's Privacy Officer at 60 Jolimont Street, Jolimont, VIC, 3002 or sending an email to [email protected].
- Entrants consent to the Promoter and Cricket Australia using the Entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter or Cricket Australia.
- The Promoter and Cricket Australia accepts no responsibility for any tax liabilities that may arise from winning the prize.
- Cricket Australia reserves the right in its absolute discretion to change or amend the International Cricket fixture without notice. Neither the Promoter nor Cricket Australia accept responsibility for the cancellation or delay of any game connected with this Promotion for any reason beyond the control of the Promoter or Cricket Australia.
- By entering this promotion entrants agree to comply, and ensure that each subsequent ticket holder complies, with the ticket conditions which accompany any tickets won in conjunction with the promotion. Entrants also agree to comply, and ensure that each subsequent ticket holder complies, with Cricket Australia’s 2022/23 Ticket and Entry Conditions (available at www.cricket.com.au/tickets) supplemented by conditions of entry imposed by the venue operator. The Promoter will provide every person attending the match as part of the promotion with a copy of Cricket Australia’s 2022/23 Ticket and Entry Conditions with delivery of the prize tickets.
- In the case of any force majeure event or circumstance not reasonably within the control of the Promoter and which by the reasonable exercise of due diligence the Promoter or Cricket Australia is not reasonably able to prevent or overcome, the Promoter reserves the right to cancel, terminate, modify or suspend the Promotion or value or type of Prize, subject to any written direction from a relevant regulatory authority (“Force Majeure Event”). Without limiting the generality of the nature of those events, a Force Majeure Event includes any act of war, terrorism or natural disaster in Australia and includes impacts on the promotion and prize fulfilment resulting from COVID 19.
- Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth).
- Subject to the previous paragraph, the Promoter and Cricket Australia are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury (including allergies, skin conditions or other reactions, as relevant), illness or death suffered in connection with this competition or any prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).
- Without limiting the previous paragraph, the Promoter and Cricket Australia are not liable for any cancellation, loss of, damage to or delay in delivery of prize/s, or for any damage that occurs to displayed prize/s (where relevant).
- These Terms and Conditions shall be governed by the laws of New South Wales and each entrant agrees to submit to the non-exclusive jurisdiction of the New South Wales Courts.
